1 — General Provisions

1. These regulations govern the terms of subscribing to the SHOTTAS online store newsletter at www.shottasseeds.com (the “Newsletter”), operated by NEXURA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (the “Organiser”).
2. Subscribing to the Newsletter is voluntary, free of charge, and independent of any purchase in the Store.
3. A valid, active e-mail address is required to use the Newsletter service.

2 — Subscription and Unsubscription

1. Subscription is completed by filling in the form on the Store’s website with a first name and e-mail address, and ticking the consent checkbox for marketing communications.
2. A confirmation e-mail (double opt-in) will be sent to the address provided. The subscription takes effect upon clicking the confirmation link.
3. The Subscriber may unsubscribe at any time, without providing a reason and without incurring any costs, by:
a. clicking the unsubscribe link included in every Newsletter message, or
b. sending a message to info@shottasseeds.com.
4. Unsubscribing does not affect the lawfulness of any processing carried out before the withdrawal of consent.

3 — 10% Discount Code

1. Every new Subscriber who signs up for the Newsletter for the first time will receive a one-time discount code entitling them to a 10% reduction on their first purchase in the Store (the “Code”).
2. The Code will be sent automatically to the e-mail address provided at sign-up within 24 hours of subscription confirmation.
3. The Code is valid for 90 days from the date it is sent. After this period, the Code expires and cannot be reinstated.
4. The Code is one-time use only, assigned exclusively to the e-mail address used at sign-up, and may not be transferred to any other person or e-mail address.
5. The Code may not be combined with other discount codes, promotions, or sales active in the Store at the time of placing the order, unless the applicable promotion rules expressly state otherwise.
6. The Code has no cash value and cannot be exchanged for money or any equivalent.
7. The Organiser reserves the right to invalidate the Code if misuse or a breach of these regulations is identified.

4 — Personal Data Protection (GDPR)

1. The data controller is NEXURA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Jana III Sobieskiego 11, Unit E6, 40-082 Katowice, Poland, e-mail: info@shottasseeds.com.
2. Personal data (first name, e-mail address) are processed pursuant to Article 6(1)(a) of the GDPR — the Subscriber’s freely given consent — for the purpose of sending the Newsletter and managing the discount Code.
3. The legal basis for sending marketing communications by electronic means is additionally provided by Article 13 of Directive 2002/58/EC (ePrivacy Directive), as implemented in the national law applicable in the Subscriber’s country of residence.
4. Data will be processed until the consent is withdrawn or the Newsletter service is discontinued. Upon withdrawal of consent, the Subscriber’s personal data will be erased within 30 days, unless their further processing is required by law (e.g. for tax or accounting purposes) or for the establishment, exercise, or defence of legal claims.
5. The Subscriber has the following rights:
a. right of access (Art. 15 GDPR);
b. right to rectification (Art. 16 GDPR);
c. right to erasure (Art. 17 GDPR);
d. right to restriction of processing (Art. 18 GDPR);
e. right to data portability (Art. 20 GDPR);
f. right to object to processing (Art. 21 GDPR);
g. right to withdraw consent at any time (Art. 7(3) GDPR) — withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal.
6. The Subscriber may lodge a complaint with a supervisory authority in their country of habitual residence. The lead supervisory authority for the controller is the President of the Personal Data Protection Office (UODO), ul. Stawki 2, 00-193 Warsaw, Poland, www.uodo.gov.pl.
7. Providing data is voluntary but necessary to use the Newsletter service.

5 — Final Provisions

1. The Organiser reserves the right to amend these regulations for valid reasons. Subscribers will be notified by e-mail at least 7 days in advance.
2. In matters not regulated by these regulations, generally applicable provisions of Polish law shall apply.
3. Notwithstanding the above, if you are a Consumer residing in a country where mandatory consumer protection laws provide you with greater protection than Polish law, those mandatory provisions of your local law shall apply to the extent they cannot be derogated from by agreement. Nothing in these regulations limits or excludes any rights you may have under the mandatory consumer protection laws of your country of habitual residence.
4. These regulations enter into force on 01.12.2025.
